Municipal Court Judge Peter Locascio Vindicated of DWI Charge

On May 19, 2010, after a three-day trial in the Superior Court in Middlesex County, Peter A. Locascio, a sitting Municipal Court Judge in Monmouth County, was found not guilty of drunk driving, refusal to submit to a breath test and reckless driving.  He was convicted of improper passing, receiving a $52.00 fine. 

He was represented by James E. Trabilsy of Wilentz, Goldman & Spitzer and Peter O’Mara of O’Mara Law Office.  The case was prosecuted by Special Monmouth County Prosecutor Stephen Monson, a former Deputy State Attorney General. 

In October, 2009, Locascio was stopped by the Middletown Police for an improper passing violation.  After he was administered standardized field sobriety tests at the side of the road, he was arrested for drunk driving and transported to the Middletown headquarters.  A breath sample was provided (.05% BAC), which yielded a reading below the legal limit.

Because Peter Locascio was a sitting Judge at the time of these offenses, the matter was transferred to the Superior Court in Middlesex County for trial.

After the acquittal, his attorney, James E. Trabilsy, remarked, “This is a great victory for Judge Locascio.  He was proven innocent of the most serious charges.  He is relieved to be able to move forward after being acquitted of drunk driving and refusal to submit to a breath test."
