Municipal Court Practice and Drunk Driving Defense

For more than 90 years, Wilentz Goldman & Spitzer P.A., has represented the interests of individuals and corporations when confronting diverse legal concerns.  Our Municipal Court Practice Group is one of the many areas that has earned our firm its reputation as committed to excellence.  The Municipal Court Practice group concentrates its practice in advocating on behalf of our clients in municipal courts throughout New Jersey.

New Jersey's Municipal Courts have jurisdiction over motor vehicle offenses, disorderly and petty disorderly persons offenses, and municipal ordinance violations.  These courts are governed by specific rules and statutes and are empowered to impose jail sentences, probation supervision, revocation of driving privileges, community service, and substantial financial penalties.  The impact of a municipal court action may result in collateral consequences such as the loss of employment, increased insurance costs and the inability to register a motor vehicle.

Our constitutional right to counsel attaches in municipal court and the appearance of counsel is recommended for nearly all municipal court matters.

Our Municipal Court Practice Group attorneys are among the most experienced and respected in the field who are well-acquainted in all aspects of municipal court defense, with a particular emphasis on the highly complex area of drunk driving.  Whether referred to as driving under the influence, DUI, driving while intoxicated, DWI, drunk driving or operating a vehicle while impaired OVI, the offense is governed by a strict plea bargaining prohibition, so attorneys must be prepared to investigate and pursue all available defenses.  These offenses are among the most serious violations resolved in New Jersey's municipal courts.

Some of the attorneys in the Criminal/Civil Rights practice group concentrate their practices in drunk driving offenses and have built a strong reputation through persistent advocacy and intense trial skills honed over years of representing defendants through pretrial discovery and motions, trials and on appeal.

Our firm has three attorneys certified to operate New Jersey's latest breath testing equipment, the Alcotest 7110mkIII-c.  These attorneys have also completed training in field sobriety testing in accordance with the National Highway Traffic Safety Administration.  In each case, we have the capacity to bring to bear our team of experienced attorneys, paralegals, and investigators to protect the rights of our clients.

The stakes have never been higher.  The penalties for driving while intoxicated and other municipal court offenses are severe and the consequences often last a lifetime.  Our Municipal Court Practice Group has the experience and legal acumen to approach the unique attributes of each case with the intent to meet the reasonable expectations of our clients.  Our proven track record has generated a reputation for both excellence in the courtroom and has earned us the respect among our peers, adversaries, and our former clients.  We believe in providing the best representation in each matter to ensure that our client's rights are protected and the right to fair trial is preserved.
