Marvin J. Brauth is a shareholder in the Business and Commercial Litigation group at Wilentz, Goldman & Spitzer, P.A. He focuses his practice on complex corporate and commercial litigation in federal and state courts of New Jersey and New York, in addition to other areas of corporate and commercial law.

Mr. Brauth regularly represents franchisees across all industries through the complete life cycle of a franchise, from inception to exit strategy, in connection with the review of offering documents and negotiation of franchise agreements, leases, business contracts, buy-sell agreements, as well as complex contract disputes with franchisors, consumers, and vendors. In addition, Mr. Brauth has significant experience handling trade secret litigation, class action defense, securities actions, and litigation concerning business, shareholder/partnership and franchise disputes, eminent domain and redevelopment law. He has litigated numerous issues involving franchise agreements and franchise laws as counsel to motor vehicle retailers and other franchisees. He has also litigated and arbitrated numerous consumer disputes and class actions and has handled governmental investigations as well as administrative and legal proceedings.

As counsel to the New Jersey Coalition of Automotive Retailers, Mr. Brauth has been involved in the drafting of the New Jersey’s franchise legislation. He has also been a frequent contributor to automotive industry publications and has lectured extensively on franchising issues.
