Wilentz lawyers represent developers and owners with respect to the structuring, and operation of various mixed-use and common interest developments featuring shared parking, open space, and amenities such as schools, golf courses, marinas, water features, environmental and open space reservations, sports arenas and retail facilities.  The firm has experience with structuring and documenting various types of common interest vehicles including condominiums, deeds of apportionment, air rights and multi-tiered use rights.  We counsel sponsors regarding project registration approvals from the New Jersey Department of Community Affairs in connection with the Planned Real Estate Development Full Disclosure Act (planned unit developments, age-restricted communities, residential condominiums), including preparation of public offering statements, master deeds, association by-laws and PREDFDA applications. Creation, operation, control and turnover of owners associations is also part of our experience.  Projects on which we have represented clients have included a mixed use transit village development, mixed use retail and low and moderate income housing, condominium hotel projects, residential and commercial condominiums and planned communities, as well as urban hotel and mixed-use projects with community and common interest restrictions and regulations.

Our Environmental Team has substantial experience in regulatory permitting, regulatory compliance and policy matters involved in development and redevelopment projects.  We practice before many state and federal governmental agencies, including the New Jersey and Pennsylvania Departments of Environmental Protection, the New York Department of Environmental Conservation and the United States Environmental Protection Agency.  Our clients' complex projects include landfill redevelopment, brownfield redevelopment, energy and infrastructure projects, climate change and sustainability matters, air compliance, site remediation including remediation under the oversight of Licensed Site Remediation Professionals, Industrial Site Recovery Act compliance, cost recovery and environmental litigation, solid waste facility permitting, Coastal Area Facilities Review Act and Coastal Zone Management Act and Waterfront Development permitting, environmental enforcement, riparian/tidelands permitting, grants, leases and licenses and administrative proceedings at all levels of government.
