U.S. District Court for the District of New Jersey Grants Final Approval of Class Action Settlement in Subaru “Starlink” Litigation

On June 30, 2020, the United States District Court for the District of New Jersey granted final approval to a class action settlement reached with Subaru related to 2017-2018 Impreza, 2018 Outback, 2018 Legacy, 2018 Crosstrek, and 2018 BRZ vehicles. The lawsuit titled Udeen et, al. v. Subaru, Case No. 1:18-CV-17334-RBK-JS, alleged that the “Starlink” infotainment systems in these vehicles was defective resulting in wide-ranging technical and performance issues. The Plaintiffs were represented by Wilentz Shareholder Kevin P. Roddy along with co-counsel Chimicles Schwartz Kriner & Donaldson-Smith LLP and Motley Rice LLC. The hearing was reportedly the first in-person court proceeding in New Jersey since closures due to the COVID-19 pandemic.

The settlement provides benefits for the class of Subaru owners and lessees estimated at over $6.25 million. This includes, among other benefits, an extended warranty covering the Starlink systems on all affected vehicles as well as the ability for class members to claim cash compensation of up to $300 if they had to have their infotainment systems repaired multiple times and/or $16/day spent without a functioning system while replacement head units were on backorder.
