Justice is moving swiftly for people injured by defective Exactech hip and knee products. On June 14, 2022, a group of plaintiffs filed a motion with the U.S. Judicial Panel on Multidistrict Litigation (JPML) to consolidate all Exactech joint replacement lawsuits in either the U.S. District Court for the Eastern District of New York, the Eastern District of Pennsylvania, or the Southern District of New York.
On October 7, 2022, the JPML found that the “centralization of these actions in the Eastern District of New York will serve the convenience of the parties and witnesses and promote the just and efficient conduct of the litigation.” Therefore, all cases in federal court will now be transferred to U.S. District Judge Nicholas G. Garaufis, who will preside over the litigation. Judge Garaufis will likely schedule an organizational hearing within the coming weeks to discuss how this litigation will proceed.
It is essential to understand that multidistrict litigation is not a class-action lawsuit. These cases will remain individual cases; however, they are coordinated together for pretrial discovery and overall case management.
