Jeffrey W. Cappola is a shareholder in the Environmental group at Wilentz, Goldman & Spitzer, P.A. For over 25 years, businesses and developers have relied on his extensive experience in brownfield and landfill redevelopment, land use, and regulatory compliance with environmental laws to obtain environmental and land use permits from local, state and federal agencies, which includes developing appropriate strategies based on their applicability. He is well versed in the provisions of the Industrial Site Recovery Act and the Resource Conservation and Recovery Act. Mr. Cappola has significant experience assisting steel and chemical manufacturers in complying with federal and state laws regarding handling, processing, storing and disposing of hazardous waste.
With regard to his real estate development practice, Mr. Cappola provides legal counsel in connection with due diligence, property acquisition, financing, permitting, liability protection, and environmental insurance. He also focuses on negotiating and drafting purchase and sale agreements as well as redevelopment agreements with municipalities. His experience includes advising clients on cost recovery/contribution options related to purchasing contaminated property. Mr. Cappola regularly works with state and federal agencies to obtain important land use permits for waterfront development projects located in coastal areas, tidelands, flood hazard areas, and wetlands. He also negotiates with regulatory agencies to obtain permits for the development of wetland mitigation banks.
In connection with his litigation practice, Mr. Cappola focuses on state and federal cost recovery matters as well as environmental insurance coverage disputes. He represents clients regarding NJ Spill Compensation and Control Act claims and federal CERCLA claims. He also defends clients in the New Jersey Office of Administrative Law with regard to enforcement actions by the New Jersey Department of Environmental Protection (NJDEP). In 2017, Mr. Cappola prevailed on behalf of Cedar Knolls 2006, LLC in its appeal of the NJDEP concerning eligibility of an Hazardous Discharge Site Remediation Fund Innocent Party grant.
Mr. Cappola is a member of the New Jersey State Bar Association, Environmental Law Section, and a member of the American Bar Association, Environment and Energy Section. He has been appointed by the NJDEP to be a member of: NJDEP-LSRP Measures Of Success Committee; NJDEP-DLUR Flood Hazard Area Rules Committee; and NJDEP Solid and Hazardous Waste Rules Committee. He is also on the board of the NJ Environmental Business Council of CIANJ.
Mr. Cappola has published articles on the NJDEP Flood Hazard Area Rules and Site Remediation Reform Act. He has contributed to the New Jersey Environmental Handbook as author of the Hazardous Substance Chapter. He also lectures on the Site Remediation Reform Act, brownfield redevelopment, corporate regulatory compliance, Flood Hazard Area Rules, state financial incentive programs and Wetland Mitigation Banks. Widely recognized as a leader in environmental law, he has been selected for inclusion in Chambers USA directory (2013-2019), New Jersey Best Lawyers list (2013-2020), and New Jersey Super Lawyers list (2012-2019).
